Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the WiFiCall mobile application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the updated Terms.

2. Eligibility

  • You must be at least 13 years old to use the Service.
  • You must provide a valid phone number capable of receiving SMS verification codes.
  • You are responsible for ensuring that your use of the Service complies with all laws applicable in your jurisdiction.
  • The Service is intended for personal, non-commercial use only.

3. Account Registration

To use the Service, you register using your phone number and a one-time verification code (OTP). You are responsible for:

  • Maintaining the security and confidentiality of your account.
  • All activity that occurs under your account.
  • Notifying us immediately at support@wificall.app if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are being used fraudulently.

4. Calling Credits and Payments

4.1 Credits

Calling credits ("Credits") are a prepaid balance used to make outbound calls through the Service. Credits are deducted at a rate of 5 credits per minute for calls to supported destinations. Rates may change with notice.

4.2 Purchases

Credits are purchased via our website through Stripe, Inc., our payment processor. All prices are in US dollars. Purchases are final and non-refundable except as required by applicable law or at our sole discretion.

4.3 Expiry

Credits do not expire as long as your account remains active. If your account is inactive for more than 24 consecutive months, any remaining Credits may be forfeited.

4.4 No refunds

Credits are non-refundable. If you believe a charge was made in error, contact us at support@wificall.app within 30 days of the transaction.

5. Acceptable Use

You agree NOT to use the Service to:

  • Make calls to emergency services (911, 999, 112, etc.) — the Service does not support emergency calling.
  • Engage in fraud, scams, phishing, or any illegal activity.
  • Harass, threaten, or harm any individual.
  • Transmit spam, unsolicited commercial messages, or robocalls.
  • Violate any applicable local, national, or international law or regulation.
  • Attempt to reverse-engineer, hack, or disrupt the Service.
  • Resell, sublicense, or commercially exploit the Service without written permission.

Violation of this section may result in immediate account termination and, where appropriate, referral to law enforcement.

6. Emergency Services Disclaimer

IMPORTANT: WiFiCall is NOT a replacement for traditional telephone service and does NOT support emergency calls (e.g., 911, 999, 112). Do not rely on this Service to contact emergency services. Always maintain access to a traditional phone line or mobile carrier for emergencies.

7. Call Quality and Availability

Call quality depends on your internet connection speed, network conditions, and the quality of the destination network. We do not guarantee:

  • Uninterrupted or error-free service
  • Specific call quality levels
  • Delivery of calls to any particular destination

We may modify, suspend, or discontinue the Service at any time without notice. We are not liable for any losses resulting from service interruptions.

8. Intellectual Property

All content, trademarks, and software associated with the Service are owned by WiFiCall or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app for personal calling purposes only. You may not copy, modify, distribute, or create derivative works from any part of the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, be available at any particular time, or be free from errors or viruses.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIFICALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST CREDITS, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 90 DAYS PRECEDING THE CLAIM.

12. Termination

You may delete your account at any time by contacting us at support@wificall.app. Upon deletion, your personal data will be removed subject to our retention obligations described in the Privacy Policy. Remaining Credits are non-refundable upon voluntary termination.

We may suspend or terminate your account without notice if you violate these Terms or if we are required to do so by law.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction, and you waive any right to a jury trial or class action proceeding.
